Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of SendVC ("the Service"), operated by SendVC ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

3. Pitch Deck Submission

By submitting your pitch deck through our platform, you grant us permission to distribute it to our network of investors. You retain all ownership rights to your pitch deck content.

Data Protection and Pitch Deck Distribution

Our processing of your personal data is described in our Privacy Policy. By submitting a pitch deck through SendVC, you warrant that you own or have the necessary rights and permissions to share the pitch deck and all information it contains, and you grant SendVC a non-exclusive, worldwide license to distribute the pitch deck to investors selected through our matching engine for the purpose of your fundraise.

You are responsible for ensuring that your pitch deck contains no false, misleading, defamatory, or infringing content. You may revoke this license at any time by deleting your account or contacting info@sendvc.app — note that copies already delivered to investors are outside our control.

4. Payment Terms

Our subscription plans start at $69/month. You can cancel anytime. There are no additional fees or commissions on any investments received.

Right of Withdrawal (Widerrufsrecht)

If you are a consumer residing in the European Union, you have the right to withdraw from the subscription contract within 14 days without giving any reason, in accordance with §355 BGB and EU Directive 2011/83/EU.

The withdrawal period expires 14 days after the day of conclusion of the contract. To exercise the right of withdrawal, you must inform us (Future Webservice, c/o Autorenglück #78416, Albert-Einstein-Straße 47, 02977 Hoyerswerda, Germany, info@sendvc.app) of your decision to withdraw by an unequivocal statement (e.g. a letter or email). You may use the model withdrawal form below, but it is not required.

Important — loss of withdrawal right for digital services: where you have given explicit consent to begin the service before the end of the withdrawal period and have acknowledged that you thereby lose your right of withdrawal once the service has been fully performed, the withdrawal right is forfeited (§356 paragraph 5 BGB). When you start the SendVC subscription and we begin distributing your pitch deck, you give this explicit consent.

Cancellation

You may cancel your subscription at any time through the dashboard or by emailing info@sendvc.app. Cancellation takes effect at the end of the current billing period — you retain access to the service until that date.

No refunds are issued for partial billing periods once the right of withdrawal under §355 BGB has expired, except where required by applicable law. Annual subscriptions purchased with a discount are non-refundable for the unused portion.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall SendVC be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, resulting from your use of the Service.

Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer with habitual residence in the EU, you retain the protection of mandatory consumer-law provisions of your country of residence.

The place of jurisdiction is Dresden, Germany, to the extent permitted by law. For consumers, the statutory rules on jurisdiction apply.

6. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. It is your responsibility to check the Terms periodically for changes.
